PSRAR ELECTION 2021--SNEAK PEEK!

Hey Gang, below are 6 ballot measures that will most likely be on the PSRAR ELECTION 2021 ballot. In that the election is fast approaching, I invite you all to take a Sneak Peek:

(1) Ballot Measure Number One – Quorum

A. Article XII, Section 5 shall be amended. Currently a quorum of the Members to conduct Association business requires 33 1/3% of the Members eligible to vote and present at a properly noticed membership meeting. This process is antiquated and inconvenient.

B. This section of the Bylaws, upon Membership approval, shall be reduced to 15% of the Members eligible to vote either in person, by mail, or by appropriate electronic means. This will allow necessary changes the Members are required to vote on to be accomplished with a more reasonable quorum and be handled in a manner more convenient to the Membership.


(2) Ballot Measure Number Two – Future Amendment of Bylaws

A. The current amendment process is very cumbersome and requires that Members vote on all Bylaw changes, even those that do not impact them. This is a waste of Association resources and prevents the Bylaws from being kept current. State law does not require certain matters to be voted on by the Members.

B. Article XV, Section 1 shall be amended to allow 70% of the total number of current Directors, to approve amendments that State law does not require be submitted to the Members. The Board of Directors will be required to approve all changes to the bylaws by the affirmative vote of no less than 70% of all Directors, regardless of the number of Directors that attend a Board of Directors meeting. At which a proposed Bylaw amendment is voted on.


(3) Ballot Measure Number Three – Allowing Affiliate Membership to Include Property Owners and Homeowners as Affiliate Members

A. Article V, Section 4 defines the qualification of Affiliate Members.

B. This section is amended to clarify that all homeowners and property owners within the Association’s jurisdiction are eligible for affiliate membership.


(4) Ballot Measure Number Four – Immediate Past President as an Officer

A. Article X, Section 1 defines officers, who are also members of the Board of Directors. The Immediate Past President is a Member of the Board but is not currently designated as an Officer. This is not typical of most Realtor® Associations.

B. This section is amended to add the Immediate Past President as an officer as well as a Director.


(5) Ballot Measure Number Five – Service on More than One Realtor® Association Board of Directors / Primary Membership

A. Article X, Section 5(b) sets forth who may be nominated for a position on the Board of Directors. It is typical at most Associations, for conflict reasons, that a person may not serve on more than one Realtor® Association Board of Directors at a time.

B. This section is amended to confirm that no person may be nominated to serve on the Board of Directors if they also serve on any other Realtor® Association Board of Directors or as a C.A.R. Director, N.A.R. Director, or MLS Director representing another Realtor® Board or Association. Further, the Bylaws are amended to state that if, at any time during any person’s service on this Association’s Board of Directors they are elected or appointed to serve on another Association’s Board of Directors, or as a C.A.R. Director, N.A.R. Director, or MLS Director and accept same that said election or appointment shall immediately service as an immediate resignation as a Director, Officer, C.A.R. Director, NAR Director, or on any Association Committee or Task Force.

C. All Directors nominated to run for the Board of Directors, or who are appointed to fill any vacancy, must, at all times, maintain primary Membership in this Association.


(6) Ballot Measure Number Six - Name Change Ratification

A. The National Association of Realtors® has approved the Association proposed name change to Greater Palm Springs REALTORS®, a yes vote ratifies the name change.
