Indian Lease Land Last Wednesday we had the representatives from the Tribe and BIA as our speakers. It was a lot of good information on how the process works and what to look for in the future. Unfortunately we did not have a lot of time to cover a large amount of material. You do not have to be an expert on Indian Lease land, just be an expert on who to call if you have questions. We, as in PSRAR are here to help and no we are not from the government. Feel free to call us with any questions and we will assist in getting you the answers. Indian lease land does not have to be as frustrating as it may seem. Another issue that seems to be on the horizon is fractional/time share type of sales. Your client receives a listing that is priced way below market calls you right away to make an offer. That is probably a 1/10th share in the property, you do not have ownership of 100% of the property. PSRAR is following up on this, as there can be several issues with this type of sale/purchase. More

Two AH-HAs Do you remember when you were in Real Estate school and you had to learn the new language and the meaning of those strange words ie: prescriptive easement; procuring cause; variable rate commission; and it goes on…Last week I wrote an offer with an “escalation clause”…”my buyer will pay $5,000. more than any acceptable offer submitted before a 72 hour expiration date”! What we don’t do these days! Another new idea came from the ClubHouse App., a Real Estate agent finds out from the Seller what their plans are and writes an offer with the Sellers plans in mind. Creative selling? I was speaking to a an experienced Broker in Manufactured/Mobile Home sales and we were talking about loan availability and he explained to me about the 433A (a process that costs approx.. $4,500. that welds the coach to cement pilings under the coach) he told me it was a safety net for the lenders. I thought it was to make the coach more stable, instead he said it was protection for the lenders so th

Clubhouse App Please Respond…as the MLS Task Force Chair, I need to know which vendor you use for your IDX feed…please send your vendor name to my email address… Karenjoy@karenjoyproperties.com I wrote an article a few weeks ago about the “ClubHouse” app…at the time it was only available for IOS, IPhone users…it is my understanding that soon it will be open to Android users, if you are interested to have an invitation to join, please also respond with your name, email and cell phone number to Karenjoy@karenjoyproperties.com I believe you can access that article in archives of the newsletter to find out more about the app. I find it very interesting to connect with some of the influencers and disruptors in Real Estate from around the world. A couple guests I have encountered on ClubHouse are Tom Ferry and an exec from Zillow. It goes on 24/7 so when you can’t sleep, you can get on ClubHouse and listen or start a conversation.

CEO - DVBA May 18, 2021 Gretchen’s Gossip…. Pssst… have you heard? Fact or Fiction FACT – California now has the highest median sales price of housing in the U.S., at a median price of $813,590…. This has pushed the affordability index (the ability to purchase housing) to a record low of 27% to the homebuying public. Median prices in Riverside County are also higher at $545,500 than just one month at ($535,000). Prices continue to be driven by higher lumber costs (up nearly 400% in one year) along other materials increased costs/limited supply; the extremely limited number of sellers listing homes; the ever-increasing cost of development cost to bringing new housing to the market. So, the questions are becoming – How long will the increased pricing continue? What can be done to get materials (i.e. lumber costs under control)? Open Houses are back! New guidance and forms! COVID Legal Documents for Open Houses The recent events surrounding the spread of the Covid-19 strain of the coronavirus has led to many questions about the continued enforceability of real estate contracts under the circumstances. Rather than risk an uncertain outcome in court or arbitration over such disputes, Buyers and Sellers may elect to address the unanswered issues contractually. The materials found at https://www.car.org/-/riskmanagement/covidlegaldocs will assist with potential issues in contracts and other issues related to best practices under the current conditions related to coronavirus. The documents are intended for members only and require you to be logged into car.org.

Indian Lease Land v Fee Land As we all know there is a major difference between Indian Lease and Fee land. The Palm Springs area is one of very few places in the US that this is a major factor. What happens when the lease runs out? Can a 99 year lease be extended? What leases are expiring? All of these questions will be answered at our next Wednesday meeting on 5/26/2021. If you have any questions or issues with a particular transaction please send it to me before the meeting. If anything comes up at a later date, please do not hesitate to contact us as we probably can help you and your clients. PSRAR ELECTION 2021--SNEAK PEEK! Hey Gang, below are 6 ballot measures that will most likely be on the PSRAR ELECTION 2021 ballot. In that the election is fast approaching, I invite you all to take a Sneak Peek: (1) Ballot Measure Number One – Quorum A. Article XII, Section 5 shall be amended. Currently a quorum of the Members to conduct Association business requires 33 1/3% of the Members eligible to vote and present at a properly noticed membership meeting. This process is antiquated and inconvenient. B. This section of the Bylaws, upon Membership approval, shall be reduced to 15% of the Members eligible to vote either in person, by mail, or by appropriate electronic means. This will allow necessary changes the Members are required to vote on to be accomplished with a more reasonable quorum and be handled in a manner more convenient to the Membership. Fact or Fiction FACT – The DVBA is continuing to move ahead with reconnecting as the world (or our little slice of it anyways) reopens. This week, DVBA CEO Gretchen Gutierrez & VP Legislative Affairs meet with City Managers in El Centro and City of Imperial, as we did 2 weeks ago with City of Brawley & County of Imperial to directly engage on topics applicable to the industry, along with distribution of the DVBA Tri-Annual Fee Study report. This report allows cities to see how they rate in terms of cost compared to adjacent or regional cities. Many cities use it as a marketing tool (for those city’s that have lower fees it is a way to attract potential development!)..  What is a 1031 Exchange? A 1031 exchange gets its name from Section 1031 of the U.S. Internal Revenue Code, which allows you to avoid paying capital gains taxes when you sell an investment property and reinvest the proceeds from the sale within certain time limits in a property or properties of like kind and equal or greater value. How does this work? How long do you have to identify the property you want to purchase? Can you live in a 1031 exchange property? Can it become your primary residence? Are the IRS rules being changed? Who can change them? All this and plus the book about Indian Lease land that is banned in the United States?? Okay, I’m confused… Do I have to wear a mask? I’m completely vaccinated, why do I have to suffocate myself when I go to Ralphs? Why is my grandchild still out of school? (Not that he learned much when he was in school!). The world seems upside down…is it because I’m elderly? (I must watch my language now, don’t want my readers to think I’m racist!!! Even though I heard that the government is helping all farmers except white men farmers…isn’t that racist? Or am I not allowed to say that either!!! I made an offer on a property in Idyllwild for 25,000 over list price last week…a small 2/2 A-Frame cabin that needed work…the listing agent said they were waiting until Monday to review offers…They had nineteen offers, and mine was not in the running. No contingencies, no inspections! I have been in this business for 50 years and I can’t understand how that is representing your buyer…I think the next few years will be spent in court, and forms will need revision again to indemnify the agents f

Fact or Fiction (no Fiction this week – just the Facts!) FACT – The DVBA introduced 3 pieces of Bill Legislation this year to the State of California (SB 318, SB 319 and AB59)…. Although SB318 and AB59 have moved to a two-bill status (suspended till 2022), SB 319 passed out of the full Senate on Monday, May 3 and now it’s on to the Assembly for consideration. This bill is a follow-up to SB1202 (Stone) that the DVBA had introduced in 2018 and signed by then Governor Jerry Brown. It sets the number of years that a public agency must conduct a full forensic audit, in the event that the agency is challenged on collection of fees.   2021 Legislative Week for NAR This week is the National Association of Realtors mid-year meeting normally held in Washington DC. The week is filled with meetings on national issues and hearing from Realtors around the country. You can register for the Zoom meetings this year and participate or watch the various events. Some issues will be 1031 Exchange, new tax laws and Independent Contractor status. There will also be meetings with our Senators and Congressman Ruiz. If you are interested in joining us next year in DC please let me know. We have a limited number of spots available for first time attendees. Also from NAR: U.S. District Court Judge Dabney L. Friedrich of the District of Columbia struck down a  nationwide eviction moratorium Wednesday, calling it unlawful. The Department of  Justice has appealed the decision. P.S.R.A.R.® is now--drumroll please………………G.P.S.R.® In a hearing held on May 4th, N.A.R.® ruled against C.D.A.R. and in favor of approving P.S.R.A.R.’s official name change request from Palm Springs Regional Association of REALTORS® to Greater Palm Springs REALTORS®. I made the motion for the name change on October 27th, 2020, which was seconded and carried by the Board of Directors--I believe unanimously. After C.D.A.R.’s challenges, objections, and rebuttals, followed by a formal mediation and an N.A.R. panel hearing, only a few hours after both Associations ardently argued their sides last Tuesday, the verdict was in. I’d like to personally thank Jim Franklin, Karen Joy and Robyn Spiller for their efforts in helping to support this rather arduous initiative that was spearheaded by our counsel, John Giardinelli and his incredible Associate, Tim Almond.
